USE AT YOUR OWN RISK

This Module is provided free of charge, AS IS, with no warranty of any kind and with no obligation on Artek to provide support, maintenance, updates, or fixes. You assume the entire risk of installing, configuring, and operating it, including the entire risk as to its quality, performance, security, and suitability for your purposes.

The Module runs inside an industrial control system and exposes gateway data and, when you configure it to, gateway control. Nothing in this Agreement obliges Artek to make the Module safe, correct, or secure in your environment — that responsibility is yours. If you are not prepared to evaluate, test, and take responsibility for the Module in your own environment, do not install it.

This End User License Agreement (“Agreement”) governs your use of the Artek-MCP module for the Ignition® platform (the “Module”). By installing or using the Module you agree to the terms below, including that you use the Module entirely at your own risk. If you do not agree, do not install the Module.

“You” means the individual or entity installing or using the Module. If you install or use the Module on behalf of an organization, you accept this Agreement on that organization’s behalf, you represent that you have authority to bind it, and “you” refers to that organization.

1. License Grant

Artek Integrated Solutions (“Artek”) grants you a non-exclusive, non-transferable, royalty-free, worldwide license to install and use the Module on any number of Ignition gateways for any lawful purpose. You may redistribute the Module only in its original, unmodified, signed form and only with this Agreement included in it unchanged. All rights not expressly granted are reserved to Artek. This Agreement conveys no ownership interest in the Module.

2. Restrictions

Except as provided in Section 3 (Third-Party Components and Open Specifications), you may not (a) modify, adapt, or create derivative works of the Module binaries; (b) reverse engineer, decompile, or disassemble the Module, except to the extent that applicable law expressly permits it despite this limitation; (c) remove or alter any copyright, trademark, or attribution notice in or accompanying the Module; or (d) represent the Module as certified by, endorsed by, or affiliated with any third party.

3. Third-Party Components and Open Specifications

The Module redistributes no third-party open-source components. It consists solely of Artek-authored code and compiles against application programming interfaces supplied by the Ignition platform and its modules, which are provided by your Ignition installation and are not redistributed with the Module. See Third-Party Notices below.

The Module implements the Model Context Protocol, an open specification developed as a project of the Agentic AI Foundation, a directed fund of the Linux Foundation, and published under the Apache License, Version 2.0. Nothing in this Agreement limits any rights you have under that license.

4. No Warranty — Use at Your Own Risk

THE MODULE IS PROVIDED “AS IS” AND “AS AVAILABLE”, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. ARTEK DOES NOT WARRANT THAT THE MODULE WILL BE ERROR-FREE, UNINTERRUPTED, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT ANY DEFECT WILL BE CORRECTED.

YOU USE THE MODULE ENTIRELY AT YOUR OWN RISK. YOU ASSUME THE ENTIRE RISK AS TO THE QUALITY, PERFORMANCE, SECURITY, ACCURACY, AND SUITABILITY OF THE MODULE, AND AS TO ALL RESULTS OBTAINED FROM IT. SHOULD THE MODULE PROVE DEFECTIVE IN ANY RESPECT, YOU — NOT ARTEK — ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR, CORRECTION, OR RECOVERY.

The Module is distributed free of charge. Artek has no obligation to provide support, maintenance, updates, patches, or security fixes for the Module, and no statement by Artek in any manual, forum post, release note, or correspondence creates such an obligation or any warranty.

Some jurisdictions do not allow the exclusion of certain warranties, so some of the exclusions in this Section may not apply to you. In that event those warranties are limited in duration and scope to the minimum permitted by applicable law.

5. Assumption of Risk and Responsibility for Deployment

Industrial control environments vary widely, and you are the only party in a position to evaluate the Module against yours. You are solely responsible for testing and validating the Module in your environment before relying on it, for deciding whether it is appropriate for any given gateway, and for the consequences of that decision, including any use in connection with processes where failure could result in personal injury or physical or environmental damage.

The Module is not designed for, and is not licensed for, use as a safety instrumented system or other safety-critical component. You are responsible for maintaining backups, change control, and independent means of recovery, and for ensuring that a failure, malfunction, or unavailability of the Module cannot by itself place your process, personnel, or equipment at risk.

6. Security, Access Control, and Data Exposure

The Module publishes a network endpoint on your gateway that is authenticated by an API key or, where you enable it, an OAuth bearer token. You are solely responsible for issuing, distributing, protecting, rotating, and revoking those credentials, for configuring the Module’s policy settings, and for restricting network access to the endpoint.

You acknowledge that responses returned by the Module can include project source and configuration, tag values and history, alarm and audit records, log text, security inventory such as user and role listings, and — where you enable the Module’s database features — the contents of rows returned from any database your gateway is connected to. Secret redaction performed by the Module is a best-effort measure and is not a guarantee that sensitive values will be withheld. When the Module is configured to permit mutating operations, an authenticated caller may change gateway state, including writing resources that the gateway subsequently executes; such a configuration confers authority comparable to an administrative credential. The Module is not a security boundary between an authenticated caller and the gateway.

You are responsible for the conduct of any person, application, artificial-intelligence system, or automated agent to which you grant access to the Module, and for your compliance with all confidentiality, data-protection, export-control, and other legal obligations applicable to information the Module discloses to such a caller. You assume all risk arising from the access you grant and from the configuration you choose, including any risk arising from disabling the Module’s read-only default, from enabling its database features, or from widening its mutation allowlist.

The Module transmits no usage, diagnostic, or telemetry data to Artek and makes no outbound network connection to Artek. Outbound requests are made only to endpoints you configure.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT WILL ARTEK BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES (INCLUDING LOSS OF PROFITS, DATA, PRODUCTION, OR BUSINESS INTERRUPTION) ARISING OUT OF OR RELATING TO THE MODULE OR THIS AGREEMENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. ARTEK’S TOTAL AGGREGATE LIABILITY UNDER THIS AGREEMENT WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID ARTEK FOR THE MODULE OR (B) FIFTY U.S. DOLLARS (US$50).

You acknowledge that the Module is provided free of charge, that the allocation of risk in Sections 4 through 6 and in this Section reflects that fact, and that Artek would not distribute the Module absent that allocation.

Nothing in this Agreement excludes or limits any liability that cannot be excluded or limited under applicable law, including liability for fraud, for willful injury to the person or property of another, or for violation of law. Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitation may not apply to you.

8. Your Indemnity

You will defend, indemnify, and hold harmless Artek and its officers, employees, and agents from and against any third-party claim, and any resulting loss, damage, liability, cost, and expense (including reasonable attorneys’ fees), arising out of or relating to (a) your installation, configuration, or operation of the Module; (b) the access you grant to the Module and the conduct of any person, application, artificial-intelligence system, or automated agent to which you grant it; (c) any data, information, or material the Module discloses to a caller as a result of your configuration; or (d) your breach of this Agreement or violation of applicable law. This Section does not apply to the extent a claim arises from Artek’s own fraud or willful misconduct.

9. Export Compliance

The Module is subject to the export control laws and regulations of the United States and may be subject to those of other jurisdictions. You may not export, re-export, or transfer the Module in violation of those laws. You represent that you are not located in, and are not a national or resident of, any country subject to a United States embargo or comprehensive sanctions, and that you are not identified on any United States government list of prohibited or restricted parties.

10. United States Government End Users

The Module is “commercial computer software” and “commercial computer software documentation” as those terms are used in 48 C.F.R. 12.212 and 48 C.F.R. 227.7202. United States Government end users acquire the Module with only those rights set forth in this Agreement.

11. Termination

This license terminates automatically if you breach this Agreement. On termination you must cease all use of the Module and uninstall it. Sections 2 through 10 and 12 through 16 survive termination.

12. Trademarks

Ignition® is a registered trademark of Inductive Automation, LLC. The Module is an independent product of Artek Integrated Solutions and is not affiliated with, endorsed by, or supported by Inductive Automation.

“Model Context Protocol” and “MCP” are marks associated with the Model Context Protocol project, a Series of LF Projects, LLC. The Module is an independent implementation of that specification and is not affiliated with, endorsed by, or certified by the Linux Foundation, the Agentic AI Foundation, LF Projects, LLC, or Anthropic, PBC.

13. Governing Law and Venue

This Agreement is governed by the laws of the State of California, without regard to its conflict-of-laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply. Exclusive venue for any dispute arising out of or relating to this Agreement lies in the state and federal courts located in Sacramento County, California, and each party consents to personal jurisdiction and venue there.

14. Severability

If any provision of this Agreement is held unenforceable, that provision will be enforced to the maximum extent permissible and the remaining provisions will remain in full force and effect.

15. General

This Agreement is the entire agreement between you and Artek concerning the Module and supersedes all prior or contemporaneous understandings regarding its subject matter. No amendment is binding unless in writing and signed by Artek. No failure or delay by Artek in exercising any right waives that right. You may not assign or transfer this Agreement, by operation of law or otherwise, without Artek’s prior written consent; any attempted assignment in violation of this Section is void. Notices to Artek under this Agreement must be sent in writing to Artek Integrated Solutions, 1024 Iron Point Road, Folsom, California 95630, United States.

16. Acknowledgment

By installing or using the Module you acknowledge that you have read this Agreement; that the Module is supplied free of charge, AS IS, without warranty and without any obligation of support; that you have satisfied yourself as to its suitability for your environment; and that you accept the entire risk of installing, configuring, and operating it.

Third-Party Notices

No third-party open-source components are redistributed in this Module. The Module archive contains one Artek-authored jar (artek-mcp-gateway, exclusively com.artek.** classes plus Artek-authored web-UI resources), the module descriptor, and Artek’s signing certificate chain. No third-party library, class, or asset is bundled, shaded, or relocated into it.

All libraries the Module uses at runtime — the Ignition Common and Gateway APIs, and the optional Perspective and Alarm Notification module APIs — are supplied by your Ignition installation under the terms of your Ignition license. They are compile-time (provided-scope) dependencies only and are neither copied into nor distributed with this Module. Accordingly, no third-party license text is reproduced here.
